Sidewalk Developer Service (SDS) Program Requirements

These SDS Program Requirements (“Program Requirements”) are part of the Amazon Developer Services Agreement (ADSA) available at https://developer.amazon.com/support/legal/da (the "Agreement"). Capitalized terms used, but not defined, in these SDS Program Requirements have the meanings given in the Agreement.

You must comply with these Program Requirements. These Program Requirements will continue to apply for as long as Sidewalk is made available by us to your SDS Products.

  1. General SDS Product Requirements.

    You agree that in connection with your (and your SDS Products’) use of Sidewalk:

    1. you will not market Sidewalk in conjunction with your SDS Products in a geographic territory where we have not made Sidewalk available;

    2. you will not charge any additional fees to any end user for access to or use of Program Materials or Sidewalk (e.g., subscription fees for Sidewalk) or any portion thereof, beyond what you charge for your SDS Products;

    3. you are solely responsible for technical and customer support for your SDS Products;

    4. your SDS Products must not do anything prohibited in the Alexa Device Requirements;

    5. your SDS Products must not expose any person to unreasonable health or safety risks, including, without limitation, any activity where the use or failure of Sidewalk could lead to death, injury, or property damage;

    6. you will display or otherwise provide to end users, and not otherwise remove, modify or obscure, any attributions, copyright information and other notices, terms and conditions that we may provide to you or that you may be required to provide to end users including for purposes of collecting and storing end user data or based on your use of third party “open source” software or other third party intellectual property in any of your SDS Products;

    7. you will be solely responsible for determining and complying with any applicable legal, regulatory or policy restrictions or requirements related to your SDS Products or the design, manufacturing, marketing, offer for sale, sale, distribution, use, and operation thereof, including without limitation U.S. and any other applicable export control and trade laws from another country; and

    8. you will not (i) misrepresent your identity or the origin of your SDS Product, (ii) mask your usage in connection with your use of Sidewalk, or (iii) provide your developer credentials to any third party.

  2. Data Privacy Requirements

    We will receive, use, and transmit personal information (as that or any similar term is defined in applicable data privacy laws) relating to your customers or users, that your SDS Products receive and then transmit over Sidewalk to:

    1. provide the SDS Services in accordance with the Agreement, including these Program Requirements and the SDS Technical Requirements;

    2. to engage in processing initiated by you or your agents in connection with using the SDS Services; and

    3. as otherwise reasonably instructed by you so long as such instructions are consistent with the Agreement, including these Program Requirements and the SDS Technical Requirements, and any other agreements you may have entered into with an Amazon affiliate.

    You agree that:

    1. you will provide end users with a reasonably prominent privacy notice and obtain any necessary consent prior to (a) collecting, using, disclosing, or otherwise processing customers’ or other individuals’ data through your SDS Product or by making your SDS Product available, and/or (b) using the SDS Services to transmit customers’ or other individuals’ data; including, without limitation, personally identifiable information or information relating to identified or identifiable individuals;

    2. you will be responsible and liable for the accuracy, integrity, and legality of the data collected through your SDS Product or by you making your SDS Product available, the manner by which you collect such data, your use of such data in connection with using Sidewalk or the SDS Services;

    3. notwithstanding anything to the contrary, and without limiting the generality of the Agreement or the Amazon Privacy Notice, Amazon may collect, use, and disclose personal information as necessary to detect data security incidents or protect against fraudulent or illegal activity and to build or improve the quality of Sidewalk and the SDS Services; and

    4. You are solely responsible for responding to individuals who seek to exercise rights they may have under applicable data protection law, as well as for any other obligations under applicable data protection law relating to data that your SDS Product collects, generates, uses or transmits via SDS services.

  3. Security Requirements.

    You agree that in connection with your (and your SDS Products’) use of Sidewalk:

    1. you will implement all reasonable security measures to ensure that no third party may gain unauthorized access from your SDS Product to Sidewalk, any Program Materials, or any data intended for or delivered by Sidewalk;

    2. you will comply with SDS Technical Requirements, which may be modified by Amazon at any time https://developer.amazon.com/acs-devices/console/sidewalk/docs/group__security__requirements.html

    3. you will not use Sidewalk or SDS Products for the purpose of monitoring, and will not monitor, the availability, performance, or functionality of any of Amazon’s products or services;

    4. you will implement in your SDS Products the Program Materials that we may require for firmware update, reporting or debugging purposes and will report such metrics or data to us;

    5. you must ensure the SDS Product firmware is updated to fix known security vulnerabilities;

    6. you will not remove, disable, modify, circumvent or interfere with any of the features or functionality we make available through Sidewalk;

    7. you will not facilitate or attempt to gain access to Sidewalk through any means other than through the provisioning and secure authentication methods we specify, and you will not disable, modify circumvent or avoid any security mechanism or protocol of the SDS or Sidewalk;

    8. you must be able to remotely update your SDS Products’ software and firmware, and design such update mechanisms so that they are secure;

    9. you will promptly (and in any event within any timeframes we expressly specify) update your SDS Products with any updates we require to any Program Materials incorporated into your SDS Products and you will enable and not prevent or interfere with any over-the-air updates we require to such Program Materials;

    10. you will protect the secrecy of any Program Materials consisting of private cryptographic keys and solely handle and install those private cryptographic keys onto an SDS Product by following our technical security requirements for private cryptographic keys;

    11. you must immediately contact us via e-mail if you become aware that any Program Materials consisting of one or more private cryptographic keys were actually, may have been, or may in the future be exposed, compromised, inadvertently disclosed, or otherwise handled in a manner inconsistent with our Technical Requirements;

    12. you will take all reasonable measures to secure the access credentials you use to access your Sidewalk developer account and will not disclose those credentials to any third party;

    13. you may not use Sidewalk for any activity where the use or failure of Sidewalk could lead to death, injury, or property damage; and

    14. you will not engage in any activity with SDS Services that interferes with, disrupts, damages, or accesses in an unauthorized manner the devices, servers, networks, or other properties or services of Amazon or any third party.

  4. Branding Requirements.

    Your SDS Product must not have a product name, domain name, logo or any other branding that includes, is a variant of, or is confusingly similar to “Sidewalk”, “Alexa”, “Echo”, “Amazon”, “Ring” or another Amazon trademark or logo. Your SDS Product must not have a form factor, design or light ring that is confusingly similar to Amazon devices, including the Amazon Echo or Ring family of devices.
